This AUP governs the use of InFiniteProHost‘s web hosting service. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and InFiniteProHost regarding the interpretation of this AUP, InFiniteProHost‘s interpretation, in its reasonable commercial judgment, shall govern.

User agrees to follow the Acceptable Use Policy of any network user connects to, including InFiniteProHost system.

Neither InFiniteProHost nor its Information Providers are responsible for any damages arising from User’s use of InFiniteProHost or by User’s inability to use InFiniteProHost service.

The following is the entire Acceptable User Policy (‘AUP‘) agreement between InFiniteProHost and the personal or corporate account holder. InFiniteProHost provides World Wide Web Hosting. InFiniteProHost has certain legal and ethical responsibilities consisting with the use of its servers and equipment involved in these services. InFiniteProHost‘s general policy is to act as a provider of Internet presence. InFiniteProHost reserves the rights to suspend or cancel a customer’s access to any or all services provided by InFiniteProHost when we decide that the account has been inappropriately used.

 

 

WHAT IS APPROPRIATE USAGE: [AUP1101]

InFiniteProHost is designed to serve the web hosting needs of small, big, huge, independently owned and operated businesses in a single country, and for personal use. It is not appropriate to use our services to support large enterprises or internationally based businesses with a sustained demand that places undue burden on our systems or negatively impacts use by small, independently owned and operated businesses.

InFiniteProHost is a shared web hosting service, which means that a number of customers’ web sites and other email or storage services are hosted from the same server. InFiniteProHost’s services must not be used for any kind of email hosting as we do not offer email hosting. InFiniteProHost uses abuse controls to help ensure that use of our services does not adversely affect the performance of our system or other customers’ sites. It is not appropriate to use an account primarily as an online storage space or for archiving electronic files.

 


DISK SPACE: [AUP1102]

If you use your services consistently with the Terms of Service and these paragraphs, your site can grow as large as necessary to meet your small business needs, but to ensure a great experience for all, we will place some constraints on how fast you can grow. The vast majority of our customers’ sites grow at rates well within our rules, but our abuse controls may cause a brief delay while we evaluate if expansion is appropriate for your particular plan.

InFiniteProHost Customers may not initiate the following (below), if any customer does InFiniteProHost may terminate the account with no refund. Depending on the situation there will/won’t be warnings sent.
a) Use 25% or more of system CPU resources for longer then 90 seconds or 1% of the servers CPU resources for longer than 5 minutes. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Use of any kind of distributed computing software, including but not limited to SETI@home, Node Zero and Folding@home.
c) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
d) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons.
e) Run any software that interfaces with an IRC (Internet Relay Chat) network.
f) Run any file sharing, bit torrent, video streaming or other P2P network services, client or server software.
g) Run any gaming servers such as counter-strike, half-life, battlefield 1492 etc

Disk Space Usage (Unlimited Plans): Your account may not be used as a storage and/or backup service for files/archives. Regular backups of databases, websites, etc, are permitted within reason. Any account found to be using an excessive and/or unreasonable amount of disk space may be asked to reduce their usage or face suspension/termination. Unlimited Reseller Hosting reserves the right to suspend/terminate any service for resource abuse at their discretion.

 

BANDWIDTH: [AUP1103]

In most cases, if you use our services consistently with our Terms of Service, visitors to your web site will be able to download and view as much content from your site as they like. However, in certain circumstances, our server processing power, server memory, or abuse controls could limit downloads from your site. You will always be able to use as much bandwidth as your account has. Bandwidth is also reset every month.

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

 

 

WEB/EMAIL STORAGE & SECURITY: [AUP1104]

You do not have to worry about hitting a storage limit if you use our services consistently with the Terms of Service and our acceptable usage policy. While there is no limit set for any accounts, your email storage usage must be within 10GB for all of your accounts altogether and if you go a little over that limit that is fine but if your account is way over the limit you must provide us with an explanation. We have the rights to suspend or terminate your account if all of your email accounts are over the limit of 10GB altogether.

InFiniteProHost will increase your space along with your appropriate small business needs, but our abuse controls may impact the rate of growth or your folder size, and there may be a short delay while we assess your usage. In some cases, creating additional folders or sub-folders will help ensure that the system works well for everyone. You will always be allowed to use as much disk space is applied to your account which should only be for website but as we do not offer any sort of email hosting your email storage should not exceed 10GB.

For Shared Hosting/Single Reseller cPanel accounts, email storage shall not exceed the 10GB limit.

Using more than 10GB of email storage per cPanel account; This limit is shared between all email addresses on any given cPanel account. Any account breaching this limit will be given a warning and 7 days to resolve the issue prior to further action being taken.

No accounts shall have backup copies of their webspace for more than two days on the server. InFiniteProHost backups all accounts to the secured cloud everyday depending on the plan purchased which is available to the customer to download locally to their own system or cloud storage. Any account that has a large backup for more than two days will be suspended without notice. This is to reduce disk over usage and that everyone gets a fair share of the disks available.

InFiniteProHost may, at its sole discretion, limit the volume of email messages You can deliver through our services. InFiniteProHost may limit email volume by queuing Your email messages internally, or by temporarily rejecting requests to send email through our services. InFiniteProHost may block any message You attempt to submit using our services, for any reason whatsoever, with or without notifying You of such blocking. Under no circumstances will InFiniteProHost be liable to You or any other party for any indirect, special, economic or consequential damages (including without limitation lost profits) arising out of email blocking or queuing.

**All content must be intended for your website use and no backups shall be kept on the web-space for more than 7 days. All backups must be removed from the server and kept locally on your computer. All of our plans come with a daily or 4/week backup plans which are kept secured remotely and are available for you to download at any time.

 

UNLIMITED or INFINITE: [AUP1105]

You may have noticed all of our accounts come with unlimited email accounts, sub-domains, FTP accounts and in some cases domains. This is subject to how much disk space your account has. So you can create as many emails, sub-domains etc as you want as long as it’s within your disk space limit. The term InFinite is based on the InFiniteProHost‘s name and there is no such thing as InFinite and all servers have a limit at some point just like ours. By purchasing any “InFinite” web-space, bandwidth, or any services with InFinite allowance, you acknowledge that they must be used for website purposes only.

* InFiniteProHost has the right to terminate any account not following the term “InFinite” for website purposes only.

“Unmetered disk space is offered with our Shared/Reseller hosting packages. This disk space is solely intended for your website and not for other storage purposes. This space must be used in accordance with our AUP, particularly [AUP1105].”

 

 

OFFENSIVE CONTENT: [AUP1106]

You may not publish or transmit via InFiniteProHost‘s service any content that InFiniteProHost reasonably believes:
a) constitutes child pornography;
b) constitutes pornography;
c) is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;
d) is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;
e) is defamatory or violates a person’s privacy;
f) creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement;
g) improperly exposes trade secrets or other confidential or proprietary information of another person;
h) is intended to assist others in defeating technical copyright protections;
i) clearly infringes on another person’s trade or service mark, patent, or other property right;
j) promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking;
k) is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to InFiniteProHost;
l) is otherwise malicious, fraudulent, or may result in retaliation against InFiniteProHost by offended viewers;

InFiniteProHost does not accept material such as:
a) Proxy, Warez, Escrow, High Yield Investment Programs (HYIP), illegal Gambling and Lottery sites.
b)Content ‘published or transmitted’ via InFiniteProHost‘s service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting or transmission that relies on any Internet service provided by InFiniteProHost.
* InFiniteProHost can terminate service for any of the above reasons and it’s at InFiniteProHost‘s sole discretion to issue a refund

 

 

SECURITY: [AUP1107]

You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically. While InFiniteProHost offers Two Factor Authentication (2-FA) on all platforms including billing/client area and the control panels you are recommended to use those functionalities to further protect your accounts.

 

BULK COMMERCIAL EMAIL: [AUP1108]

Bulk commercial email, mailing lists and email reflectors are allowed on InFiniteProHost‘s servers, we do however allow a maximum of 100 emails per hour per account. For any emails sent from your InFiniteProHost account you must adhere to the following rules:

a) Your intended recipients have given their consent to receive e-mail via some affirmative means, such as an opt-in procedure;
b) Your procedures for soliciting consent include reasonable means to ensure that the person giving consent is the owner of the e-mail address for which the consent is given;
c) You may not obscure the source of your e-mail in any manner.
d) You otherwise comply with the CAN SPAM Act and other applicable law.

These policies apply to messages sent using your InFiniteProHost service, or to messages sent from any network by you or any person on your behalf that directly or indirectly refer the recipient to a site hosted via your InFiniteProHost service. In addition, you may not use a third party e-mail service that does not practice similar procedures for all its customers.

 

UNSOLICITED EMAIL: [AUP1119]

You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it. You must comply with the rules of any other network you access or participate in using your InFiniteProHost‘s services.

 

MATERIAL PROTECTED BY COPYRIGHT: [AUP1115]

You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:
a) you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner.
b) you are otherwise permitted by established United States copyright law to copy the work in that manner.

InFiniteProHost will terminate the service of repeat copyright infringers.

 

 

OTHER: [AUP1116]

You must have valid and current information on file with your domain name registrar for any domain hosted on the InFiniteProHost network.

 

 

DISCLAIMER: [AUP1117]

InFiniteProHost is under no duty, and does not by this AUP undertake a duty, to monitor or police our customers’ activities and disclaims any responsibility for any misuse of the InFiniteProHost network.

 

 

INTERNET ABUSE: [AUP1118]

You may not engage in illegal, abusive, or irresponsible behavior, including:

a) Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures (including those belonging to InFiniteProHost and its customers) without express authorization of the owner of the system or network;
b) monitoring data or traffic on any network or system without the authorization of the owner of the system or network;
c) Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;
d) Use of an Internet account or computer without the owner’s authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security hole scanning, and port scanning;
e) Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or
f) Any conduct that is likely to result in retaliation against the InFiniteProHost network.
g) Use of InFiniteProHost‘s network in a way that unreasonably interferes with InFiniteProHost‘s other customers use of the network

 

All un-metered Shared Hosting or Reseller Hosting are installed on 10000 mbps shared bandwidth ports, unless service is sold as a specified port size or specified/requested as a capped port. InFiniteProHost reserves the right to monitor network usage, and if a service significantly exceeds average usage, to throttle the available speed to conserve network resources. This will generally not include short spikes in usage, but will include, but not be limited to, sustained transfers of significantly larger than average amounts of bandwidth. If at any time any client’s data transfer rate affects other InFiniteProHost client, InFiniteProHost reserves the right to throttle the service causing such a problem.

 

NEWSGROUP, CHAT FORUMS, OTHER NETWORKS : [AUP1114]

You must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which you participate, such as IRC and USENET groups including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass postings to multiple forums.

 

RESELLER HOSTING: [AUP1119]

You must not use our RESELLER HOSTING ACCOUNTS to offer any of the following kinds of FREE services but are not limited to; Free Web hosting services, Free e-mail services, Free blogging services, Free home pages, Free image hosting, Free trial accounts. There are several reasons for these prohibitions on free services. The reasons include, but are not necessarily limited to, the following:

First, free services generally do not require any reliable means of identifying the person who registers for them. As such, it can be practically impossible to track down persons who abuse the free services.

Our customers, including (resellers) are all paying for prompt, reliable service and we have built a solid reputation for delivering excellent service to them. We cannot risk having unidentified persons damage our reputation.

Users of free services are notorious for registering for free accounts and immediately spamming or otherwise consuming very large amounts of system resources and bandwidth before their accounts are shut down. Such abusers often register for successive or multiple accounts and cause many problems for the servers and network.

Spammers, operators of phishing and harming scams, distributors of spyware, viruses, Trojan horses, worms, and other malware, operators of illegal Warez sites, operators of illegal or unauthorized file-swapping or archive sites, and hackers frequently abuse free online services. Allowing free services would expose our servers to severe abuse and could harm us or all of our customers, and all the customers of our resellers.

Free services lead to various forms of abuses that may violate criminal laws or even foster terrorist activities. Because such abuses violate applicable laws as well as our policies, we must prohibit them.

If you violate this prohibition on free services, we may suspend your account immediately, with or without notice, as we in our sole discretion deem necessary to address the situation.

INFINITEPROHOST STAFF: [AUP1110]

Abuse of InFiniteProHost Staff or Support Personnel: At InFiniteProHost, we take pride in providing excellent service to all of our customers. It is our policy always to treat our customers with the highest level of respect and courtesy. In return, we expect the same respect and courtesy from you. If our staff feels that you are consistently engaging in abusive content toward them, or addressing them in a demeaning or rude manner, your account(s) may be suspended and you may be asked to take your business elsewhere. In the event that we terminate service for abusive conduct, customers will be given five (5) days’ notice. We will not issue a refund for the unused portion of pre-paid service. Abusive conduct includes, but is not limited to, the following behaviors:

 

Repeatedly addressing members of our staff in a demeaning or rude manner. Using profanity in any oral or written communications with our staff, by any medium of communication, including but not limited to e-mail, instant messages, chat, text messaging, fax, postal mail, telephone, voice over Internet Protocol, or in-person communication. Yelling or shouting at our staff. Deliberately using all capital (uppercase) letters in any written communication to our staff; Insulting our staff because of their personal characteristics, or on the basis of their race, ethnicity, national origin, sex, sexual orientation, religion, or housing or economic status; or Deliberately providing false information to our staff for the purpose of harassing them or wasting their time.

 

Users whose accounts are terminated for any of the above infractions are also responsible for the cost of labor to cleanup and respond to complaints incurred by InFiniteProHost.
